How many days of leave you are entitled to

In Poland, leave is 20 or 26 days per year, and this depends not only on work experience, but also on education: schooling adds years to your service record. Calculate your days and the value of unused leave.

Approximate calculation for umowa o pracę. The monetary amount for unused days (ekwiwalent) is estimated roughly: the exact "współczynnik ekwiwalentu" is set by the state separately every year, so the final amount will be calculated by a księgowa. Under umowa zlecenia, there is no paid leave under the Labor Code.

20 or 26 days — what it depends on

The duration of paid leave under umowa o pracę depends on total seniority: up to 10 years — 20 days per year, from 10 years — 26 days. The main thing most newcomers don't know: education is also counted toward seniority. Higher education adds 8 years, post-secondary school — 6, secondary vocational — 5, general secondary — 4, vocational — 3.

Years of study are not added together — only the highest level is taken. Therefore, a person with higher education and two years of work already has 10 years of "leave seniority" and the right to 26 days.

Proportion and part-time

If you do not work the whole year, leave is accrued proportionally: 1/12 of the standard for each month worked. On a part-time basis, the standard is reduced by the same proportion (for 1/2 position — half the days).

FAQ

Can you skip leave and take money instead?
No. Money instead of leave (ekwiwalent) is paid only upon dismissal for unused days. While you are working, you must take your leave.
Does leave expire?
Unused leave rolls over to the next year — it must be used by September 30. The right to it does not disappear immediately: the claim is subject to general limitation periods.
What about umowa zlecenia?
There is no paid leave under the Labor Code there — this is not an employment contract. Sometimes parties specify "free days" in the contract itself, but this is not the same as urlop.
